1. Acceptance of These Terms

Welcome to Coach Icarus, an AI-powered running coach developed by Icarus Ventures LLC ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Coach Icarus website, mobile applications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

2. The Service

Coach Icarus organizes your training data — activities, sleep, heart-rate variability, and daily metrics — and uses it to coach your running. The free tier includes activity sync, HRV and sleep tracking, and recovery insights. The Coach tier adds adaptive race plans, post-run coach debriefs, and recovery-aware weekly briefings. We may add, change, or remove features at any time as the Service evolves.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us promptly at support@coachicarus.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, Trials & Billing

The Coach tier is offered as a monthly subscription, currently priced at $9.99 per month, and includes a 14-day free trial. Subscriptions are billed through the app store or platform you subscribed on (Apple App Store or Google Play). If you do not cancel before the trial ends, your subscription converts to a paid subscription and you will be charged. You can manage or cancel your subscription at any time in your device's subscription settings; cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of the applicable app store.

6. Acceptable Use

You agree not to misuse the Service. In particular, you will not:

• Attempt to access accounts, data, or systems you are not authorized to access, including by circumventing authentication or rate limits.
• Scrape, bulk-download, or resell Service data or content, or use automated means to abuse the Service.
• Upload or transmit malware, spam, or unlawful content, or use the Service for any unlawful purpose.
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure.
• Misrepresent your identity or your affiliation with any person or organization.

7. API Access & API Keys

Where we make programmatic access available (for example, personal API keys for integrations such as AI assistants), your keys are issued to you personally and remain your responsibility. Keep them secret, do not share or publish them, and revoke any key you believe is compromised. We may rate-limit, suspend, or revoke API access at any time, including for suspected abuse or violation of these Terms. API access is provided for your own training data only; you may not use it to access another person's data.

8. Health & Fitness Disclaimer

Coach Icarus is a fitness and wellness tool. It does not provide medical advice, diagnosis, or treatment. Training plans, recovery verdicts, and other coaching outputs are informational and are not a substitute for professional medical guidance. Always consult a qualified healthcare provider before beginning an exercise program or acting on information from the Service, especially if you have a medical condition, are injured, or are pregnant. Stop exercising and seek medical attention if you experience pain, dizziness, chest discomfort, or other concerning symptoms.

9. Third-Party Services

The Service integrates with third-party platforms such as Garmin Connect, Apple HealthKit, and Google Health Connect, and is distributed through the Apple App Store and Google Play. Your use of those platforms is governed by their own terms and privacy policies, and we are not responsible for their actions, outages, or data practices.

10. Intellectual Property

The Service, including its software, designs, text, graphics, and the Coach Icarus name and marks, is owned by Icarus Ventures LLC or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms. Your training data remains yours; by using the Service you grant us the license described in our Privacy Policy to process it in order to operate and improve the Service.

11. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or for any other reason. Upon termination, your right to use the Service ends immediately; provisions that by their nature should survive (including intellectual property, disclaimers, and limitations of liability) will survive.

12. Disclaimers & Limitation of Liability

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. To the maximum extent permitted by law, Icarus Ventures LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim will not exceed the amounts you paid us in the twelve months preceding the claim, or $50 if you paid nothing.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above and, for material changes, provide notice through the Service or by email. Your continued use of the Service after the changes take effect means you accept the updated Terms.
